Can I legally start a small business in California while working in the United States under a “TN” visa?

John S asked:

The business will be very simple. In general it will offer a service through direct mail, receive responses, perform analysis/research for the customer and return the results to the customer. I would like to operate this business as a sole proprietorship while continuing to work at my full-time visa-sponsored position.

Thanks in advance for any responses.

I don’t see any objection to that, as long as you continue to reside legally in the country. Make sure you declare your revenue to stay out of trouble. You can. guevara C

Anyone on an employment visa is restricted to working for the employer which sponsored the visa.

If you want to start your own biz, get an investor’s visa. $1 million minimum investment, and you must hire a minimum of 10 Americans. You’ll also need enough money to support yourself until the biz is generating sufficient cashflow to draw a salary. ibu guru
